MUSICHOOL
USER & MEMBERSHIP AGREEMENT
Parties
This agreement has been drawn up between Musichool Oร (hereinafter referred to as "Musichool"), domiciled at "Musichool Oร, Pohja-Tallinna linnaosa, Paavli tn 5a/1, 10412, Harju maakond, Tallinn, Estonia," which conducts its activities on the website with the extension www.musichool.co/tr (hereinafter referred to as the "Site"), and the user who is a member of the Site or who benefits from the Site without becoming a member (hereinafter referred to as the "Member"). Hereinafter, Musichool and the Member may collectively be referred to as the "Parties."
Subject
The subject of this Agreement is the determination of the conditions under which the Member may benefit from the Site and the electronic presentation of the products and services displayed through the Site by Musichool to the Member.
Obligations
Musichool accepts and undertakes that, except in cases of force majeure, the Member shall be enabled to benefit from the services and products offered on the Site.
The Member agrees not to produce or share content in activity communications within the Site that is contrary to public morals and the law, that infringes the rights of third parties, that is misleading, aggressive, obscene, pornographic, detrimental to personal rights, contrary to intellectual and industrial property rights, or that encourages illegal activities. Otherwise, liability for any resulting damage shall rest solely with the Member, and in such cases, Musichool authorities reserve the right to suspend or terminate such accounts and to initiate legal proceedings against them.
The Member accepts and undertakes not to copy, reproduce, or make available to third parties, under any circumstances or conditions, any material found on the Site, particularly the lessons protected by the intellectual property rights of instructors.
All matters related to the security of the system access tools used by the Member to benefit from the products and services offered by Musichool are entirely the responsibility of the Member. Musichool bears no direct or indirect liability for any damages suffered or that may be suffered by the Member and/or third parties due to the Member's negligence and faults in matters such as the security of system login tools, the storage of such information, and their protection against third parties.
The Member accepts, declares, and undertakes that the information and content provided by the Member within the Site is accurate and in compliance with the law. Musichool is not obligated to investigate the accuracy or currency of the data transmitted by the Member, nor to guarantee or warrant that such information is secure and in compliance with the law. Musichool cannot be held liable for any damages arising from the inaccuracy or incompleteness of such information and content.
The Member may not transfer, in whole or in part, the rights and obligations under this agreement to a third party without the written consent of Musichool.
In the event that the Parties act in violation of this article, the Party acting in violation accepts and undertakes to pay the other Party a penalty clause in the amount of one year's membership fee.
Effectiveness
By checking the consent box (opt-in) related to this agreement during the process of registering as a member or continuing without becoming a member, it is understood that the Member has read and accepted all the articles of this agreement. This agreement enters into force mutually at the moment the Member registers on the Site. In the case of continuing without becoming a member, the agreement is deemed concluded upon checking the consent box and enters into force mutually.
Protection of Personal Data
Musichool has published the Website Disclosure Notice Regarding the Protection of Personal Data for the purpose of compliance with personal data protection legislation. The aforementioned text explains how and to whom the Member's personal information will be processed and transferred, and the Member has been informed in detail about their legal rights.
By approving this agreement, the Member accepts and declares that they have read and understood the disclosure regarding the processing of their personal data.
Termination of the Agreement
This agreement shall remain in force until terminated by the Parties for any reason. Musichool may unilaterally terminate the agreement of any Member who violates any provision of this agreement.
Force Majeure
If the obligations arising from the agreement become impossible for Musichool to fulfill due to reasons beyond the control of the Parties, such as natural disasters, fire, explosions, civil wars, wars, uprisings, popular movements, declaration of mobilization, strikes, lockouts and epidemics, infrastructure and internet failures, power outages (hereinafter collectively referred to as "Force Majeure"), Musichool shall not be held liable. During this period, the rights and obligations of the Parties arising from the Agreement shall be suspended.
Revision
Musichool may partially or fully change the services offered on the Site and the terms of this agreement due to commercial interests and changes in legislative provisions. It is the Member's responsibility to follow the changes published on the Site.
Notifications
All notifications to be sent to the Parties regarding this Agreement shall be sent to the address or email address provided by the Member to Musichool during this agreement or any other transaction. The Member accepts in advance that the address specified during this agreement is the valid notification address, that in the event of a change they will notify the other Party in writing within 5 days, and that otherwise notifications/notices sent to this address shall be deemed valid.
Resolution of Disputes
Istanbul Anatolian Courts and Enforcement Offices are authorized for the resolution of all disputes arising from the application of this agreement.
